Terms of Sale – Ayatana Within
1. Definitions
1.1 “Company” refers to Ayatana Within, its successors, assigns, or any authorised person acting on behalf of Ayatana Within.
1.2 “Customer” refers to any person or entity purchasing goods from the Company.
1.3 “Goods” refers to all products and services provided by the Company to the Customer.
1.4 “Price” refers to the amount payable for the Goods as agreed between the Company and the Customer.
2. Acceptance of Terms
2.1 By placing an order or accepting delivery of Goods, the Customer agrees to these terms and conditions.
2.2 These terms can only be modified with the Company’s written consent and override any conflicting agreements.
3. Orders & Payment
3.1 Pricing: Prices are subject to change without notice. The final price will be as stated at checkout or on an invoice.
3.2 Payment Methods: Payments must be made via accepted payment methods (e.g., credit/debit card, bank transfer, PayPal, or any method approved by the Company).
3.3 Payment Terms: Unless otherwise agreed, all orders must be paid in full before dispatch. If a business account is approved, payment must be made within 30 days of invoice.
4. Delivery & Risk
4.1 Delivery Methods: The Company will arrange delivery via postal service. Shipping costs may be included in the price or charged separately.
4.2 Delivery Times: Any estimated delivery date is a guideline. The Company is not liable for delays beyond its control.
4.3 Risk Transfer: Risk passes to the Customer upon delivery. The Customer is responsible for ensuring the safe storage and use of the Goods.
4.4 Non-Delivery: If the Customer is unavailable at the time of delivery, the Company may charge a redelivery or storage fee.
5. Returns & Refunds
5.1 Change of Mind Returns: Returns for non-faulty items are accepted at the Company's discretion. If approved, items must be returned in original condition at the Customer’s expense.
5.2 Faulty or Incorrect Goods: If an item is damaged, defective, or incorrect upon arrival, the Customer must notify the Company within 48 hours of delivery. The Company will provide a replacement or refund in compliance with Australian Consumer Law.
5.3 Refund Process: Refunds will be processed using the original payment method within a reasonable timeframe.
6. Ownership & Title
6.1 Ownership of the Goods remains with the Company until full payment has been received.
7. Liability & Warranties
7.1 The Company provides Goods in accordance with Australian Consumer Law. The Customer is entitled to a repair, replacement, or refund if Goods are faulty or do not perform as described.
7.2 The Company is not responsible for damage caused by misuse, improper storage, or failure to follow usage instructions.
7.3 Liability for any claim shall not exceed the purchase price of the Goods.
8. Privacy Policy
8.1 The Company collects personal information necessary for order fulfilment and customer service. This includes name, contact details, and payment information.
8.2 Customer information is stored securely and will not be shared with third parties except as required by law or for essential business operations (e.g., shipping providers).
8.3 Customers have the right to request access to, or correction of, their personal information.
9. General Provisions
9.1 Force Majeure: The Company is not liable for delays or failure to perform obligations due to events beyond its control (e.g., natural disasters, strikes, or supply chain disruptions).
9.2 Governing Law: These terms are governed by the laws of Western Australia.
